California’s Gun Purchase Limit Struck Down: 9th Circuit Court Rules ‘One Gun a Month’ Unconstitutional

In a significant victory for gun rights advocates, the 9th Circuit Court of Appeals has declared California’s controversial “one-gun-a-month” law unconstitutional. The ruling, issued on June 20th, upholds a previous lower court decision and solidifies the Second Amendment’s protection against restrictions on firearm acquisition.

Circuit Judge Danielle Forrest’s opinion clearly states that the law’s restriction violates the Second Amendment’s plain text. The court rejected California’s argument that the amendment only guarantees the right to possess a single firearm. The ruling emphasizes that the Second Amendment protects the right to possess multiple firearms and prohibits significant limitations on purchasing them.

California’s defense centered on the idea that individuals who already owned at least one firearm had not experienced an infringement of their rights. However, the 9th Circuit directly countered this argument in its decision. This landmark ruling is expected to have far-reaching implications for gun control laws across the nation, particularly in states with similar restrictions.
